Political asylum is a form of immigration relief available to individuals who are inside the United States, but who cannot return to their home country because they fear that they will be harmed because of their race, religion, nationality, political opinion, or “membership in a particular social group.”  Asylum status permits a person to remain lawfully within the United States, obtain employment authorization, and, eventually obtain a Green Card.

Special instructions

Please note that, as a general rule, applications for asylum must be filed within one year of a person’s arrival to the United States.  There are a number of exceptions to this general rule (and these exceptions are discussed at length in this package), but, if at all possible, you should endeavor to file within one year.  

This package is intended for use only by individuals who are not in Removal Proceedings (in front of an Immigration Judge).  If you are currently in Removal Proceedings, you may still be eligible to apply for asylum, but the application procedure will be very different.  If you are in Removal Proceedings, you should consult with an experienced immigration attorney in order to learn more about how to submit your application.  

You may be ineligible for asylum if you have been convicted of a serious, non-political crime.  If you have ever been convicted of a crime, it is strongly advisable to speak to an experienced immigration attorney before deciding whether to file your application.  

It is not possible to file for asylum unless you are physically present in the United States.  Do not purchase this packet if you are outside the United States.
