Who should buy this package?

You should buy this package if you think that you are up to the challenge of dealing with the U.S. immigration system without an attorney, but you would like a bit of guidance before taking the plunge!  This package contains helpful information for non-citizens seeking Green Cards on the basis that they are the parent of a U.S. citizen, and the U.S. citizen child is 21 years of age or older.  This packet is designed to provide instructions for non-citizen parents who reside in the United States. 

This package should only be used for cases in which: 

  1. The non-citizen parent has a U.S. citizen child (including biological children, stepchildren, or adoptive children, subject to the limitations described below);
  2. The U.S. citizen child is 21 years of age or older;
  3. The non-citizen parent is currently within the United States;
  4. The non-citizen parent entered the United States with a visa;
  5. The non-citizen parent does not have a criminal history; and
  6. The non-citizen parent does not have a problematic immigration history. 

Please note that immigration law will only recognizes the validity of a parent-child relationship in the following circumstances:

  • When a parent and child are biologically related, and:
    • The parent is the child’s mother;
    • The parent is the child’s father and the child was born while the child’s father and the child’s mother were legally married;
    • The parent is the child’s father, the child’s mother and father were not married at the time the child was born, but the father and child can prove that they shared a bona fide relationship prior to the child’s 21st birthday;
  • When a parent and child are related by adoption, so long as the parent adopted the child before the child turned 16 years old; and
  • When the parent is a stepparent of a child, so long as the marriage creating the stepparent relationship occurred prior to the child’s 18th birthday. 

Please note that a U.S. citizen child cannot file a petition for his or her parents until the child turns 21 years old. It is not possible for a child under the age of 21 to file a petition for his or her parents.

Following the instructions in this package may prevent you receiving a Request for Additional Evidence on your application, or, worse, a denial.

Special instructions

Do not purchase this package if the non-citizen parent is residing abroad.  The non-citizen parent must be living in the United States both at the time of filing and until he or she receives their Green Card.

The information in this packet applies only when the non-citizen parent legally entered the United States with a visa.  If the non-citizen parent did not have a visa when he or she entered the United States, it will not be possible for the non-citizen to get a Green Card through the method described in this packet.  If the non-citizen parent is currently in the United States but did not enter with a visa, you should speak with an experienced immigration attorney prior to filing any paperwork.

If the non-citizen parent has ever been convicted of a crime, no matter how serious, it is always a good idea to speak with an immigration attorney before filing an application with USCIS.  If the non-citizen parent has a criminal history, do not file any paperwork unless you are 100% sure that your criminal history will not hinder his or her ability to get a Green Card.

This package should not be used if the non-citizen parent has ever had a hearing scheduled in front of an Immigration Judge.  If the non-citizen parent either was or is in Removal Proceedings, consult with an experienced immigration attorney before filing your application.
