This package should only be used for cases in which:
- the non-citizen spouse is currently within the United States;
- the non-citizen spouse entered the United States with a visa or was paroled;

Special instructions
Do not purchase this package if either the U.S. citizen spouse or the non-citizen spouse is residing abroad. You must be living in the United States with your spouse both at the time of filing and until you receive your Green Card.
The information in this packet applies only when the non-citizen legally entered the United States with a visa or was paroled. If the non-citizen did not have a visa when he or she entered the United States, it will not be possible for the non-citizen to get a Green Card through the method described in this packet.
In order to successfully file a marriage petition, the marriage must be legally valid in the state or country in which the marriage took place. For example, if you are in a same-sex marriage, you may obtain a Green Card if the country in which your marriage took place recognizes the validity of same-sex marriages.
If you have ever been convicted of a crime, no matter how serious, it is always a good idea to speak with an immigration attorney before filing an application with USCIS. If you have a criminal history, do not file any paperwork unless you are 100% sure that your criminal history will not hinder your ability to get a Green Card.
This package should not be used if the non-citizen spouse has ever had a hearing scheduled in front of an Immigration Judge. If the non-citizen spouse either was or is in Removal Proceedings, consult with an experienced immigration attorney before filing your application.
